Dr Ligia Catherine Arias Barrera (Commercial and Corporate Law LLM, 2011) is an award winning author of several books and an independent expert at the European Commission, the IMF, the IFC, and the UK parliament. As CEO of Financial Services Consulting, she provides consultancy services focusing on sustainable finance, capital markets, carbon markets, and fintech within securities markets. She works as a Professor of Financial Law in Universidad Externado de Colombia.

This is what Catherine says about her new book: “The realm of sustainable finance stands at a pivotal crossroads, where the convergence of legal frameworks and societal imperatives reshapes the landscape of global investment. In my latest work, The Law of ESG Derivatives: Risk, Uncertainty and Sustainable Finance, I delve into the intricate interplay between legal regimes governing Environment, Social, and Governance (ESG) derivatives and their profound sociological implications.

ESG derivatives have emerged as transformative tools, channelling capital towards sustainability objectives while strategically managing associated risks and uncertainties. This book represents a comprehensive legal analysis of these derivatives, exploring their capacity to enhance sustainable investment practices and mitigate ESG-related risks. It not only identifies regulatory gaps but proposes innovative solutions to address market inefficiencies that hinder progress in sustainable finance.

At its core, this book serves as a strategic roadmap for policymakers and advocacy groups navigating the complexities of sustainable finance. It illuminates the diverse applications of ESG derivatives across different jurisdictions, offering practical insights for crafting effective policy frameworks. By bridging the gap between legal discourse and societal impact, the book aims to empower stakeholders—from scholars and practitioners to policymakers—with the knowledge to leverage ESG derivatives as catalysts for sustainable development.

What led me to embark on this journey of exploration was a recognition of the transformative potential of ESG derivatives in shaping the future of global finance. As an academic and practitioner deeply engaged in both legal studies and societal dynamics, I observed a critical need for a comprehensive resource that integrates legal analysis with sociological perspectives on sustainable finance. This book represents my endeavour to fill that void, offering a nuanced understanding of how legal frameworks can drive positive societal change through sustainable investment practices.

By weaving together rigorous legal analysis with insightful sociological perspectives, The Law of ESG Derivatives aims to inspire a multidisciplinary dialogue among scholars, experts, and policymakers. It invites readers to explore not only the technical intricacies of ESG derivatives but also their broader implications for reshaping financial markets in alignment with sustainability goals. Whether you are a legal scholar delving into the complexities of regulatory frameworks or a business leader navigating the evolving landscape of sustainable finance, this book offers a comprehensive guide to understanding the transformative power of ESG derivatives.

In conclusion, The Law of ESG Derivatives: Risk, Uncertainty and Sustainable Finance stands as a testament to the potential of legal scholarship to drive meaningful societal change. It invites readers on a journey to explore the intersection of law, finance, and society—a journey that promises to shape the future of global investment towards a more sustainable and inclusive economy”.
