International Asset Tracing and Recovery

The Centre for Commercial Law Studies from Queen Mary University of London is delighted to announce the return of the popular International Asset Recovery Course.

Programme description and aims

The course is a three-day programme that will help you build upon your existing expertise in this area by focusing on the legal and practical aspects that are of critical importance to the practitioner. The course will centre around an asset recovery case study, which will develop as the course progresses, and will take participants through all stages of the process, confronting you with challenges you are likely to face.

Through a mixture of small group sessions and wider discussion, you will explore key topical areas, identify problems that have occurred in actual cases, and arrive at potential solutions.  You will benefit from the differing perspectives of your peers from across the fraud and asset recovery professions and compare different practices and approaches. 

Our programme will prepare you to

  • Instinctively identify the key issues that arise at each stage of the asset tracing and recovery exercise
  • Pre-empt and avoid the pitfalls that can arise in fraud cases
  • Provide strategic and tactical insight into when and when not to go for injunctive relief
  • Navigate the challenges of multi-jurisdictional asset recovery cases and find creative solutions
  • Reduce the time and costs spent in asset tracing and recovery exercises
  • Efficiently execute orders and convert claims into recovered assets

Delivery format:

  • Interactive seminars, small group sessions, and case study discussions
  • English legal system centric but with reference to civil law countries.

The course will centre around an asset recovery case study which will form the focal point of the course and develop as the course progresses. You will be divided into investigative teams, working as independent task force groups for the whole duration of the programme. Group discussions will focus on key topical areas, identify problems that have occurred in actual cases, arrive at potential solutions and compare different practices and approaches between the groups.

It will be delivered by a group of leading specialist fraud practitioners from Blackstone Chambers and Mishcon de Reya. The course is led by Mr Gary Miller, a Partner and Chairman of the International Fraud Group at Mishcon, supported by highly rated junior barristers Mr Luka Krsljanin and Mr Ajay Ratan, both of Blackstone Chambers, and Philippa Rees, a Professional Support Lawyer at Mishcon. Between them, the speakers bring to the course many years of experience in tracing, freezing and seizing evidence and assets all over the world.

Speakers:

  • Gary Miller, Mishcon de Reya
    Gary Miller has been involved in International asset tracing and recovery for over 45 years, has been a Partner at Mishcon de Reya LLP for over 31 years and is Head of Mishcon’s Asia Desk. He is also Chairman of the International Fraud Group.
  • Philippa Rees, Mishcon de Reya
    Philippa Rees has over 15 years’ experience of commercial fraud cases, both as a solicitor, and more recently as a Professional Support Lawyer, providing specialist expertise on injunctive relief and asset recovery
  • Ajay Ratan, Blackstone Chambers 
    Ajay is a leading junior barrister with a specialism in civil fraud disputes. He has experience in a number of offshore jurisdictions as well as before the Commercial Court, Privy Council and Court of Appeal. Current work includes Renova v Emmerson, a BVI claim for c.US$1 billion.

Participants

The programme is designed for senior professionals in the fraud and asset recovery market, primarily targeted toward lawyers, investigators, forensic accountants, insolvency practitioners and litigation funders.
