SOLM340 WTO Law: Trade Remedies
Module description
This module looks at the rationale for imposing anti-dumping measures, countervailing duties and safeguards to protect domestic economies. It examines the different WTO agreements and rules that apply to regulate trade remedies and settle disputes over their imposition.
While anti-dumping measures and countervailing duties may seem to go against the objectives of the WTO, they are seen as a safety value to address domestic economic tensions and instabilities. Nevertheless, they are carefully regulated through WTO agreements to ensure that they are fair and do not impose unfair remedies. Various controversies have arisen in the area of trade remedies, that will be examined throughout the course, including the legality of green subsidies to mitigate the climate crisis the use of zeroing calculations and how EU competition law regulates unfair trade measures such as dumping.
